Public Hearing on one year Detention Center Moratorium, Ordinance 6926. The City needs time to study and evaluate updates to City Code, local zoning, and associated land use controls to provide specific development regulations, zoning, and permit processes to address and mitigate potential impacts associated with detention center use in the City of Bellevue. This establishes the work plan for staff to generate the code update.
Development Services Update: In the first half of 2026, several major projects have started construction, several more have received permit approval to start construction, and there are large commercial tenant improvement projects to build out office space …. an increase in the level of investment moving from the review pipeline to the construction phase.
Also during that time, Development Services received over 8,200 permit applications and issued over 7,800 permits, representing continued high volumes in both categories. Drivers are investments in new single-family housing, residential reinvestment projects, and new applications stemming from affordable housing incentives, middle housing, and the updated zoning and 2 development regulations adopted as part of the Wilburton Vision Implementation Land Use Code Amendment (LUCA).
For over a year and a half, Bellevue has worked to drive down permitting timelines in accordance with SB 5290’s changes to the Local Project Review Act. SB 5290 requires 65, 100, and 170 day permit review periods depending on whether a project requires public notice or a public hearing. Bellevue also cares about our time to first review decision, though these targets were not required by SB 5290; performance against this key metric improved from 72% to 82% of the decisions (targets range from 1-8 weeks, depending on complexity).
Development Services also has ongoing improvement efforts were shaped by feedback received through the Department’s strategic planning effort, customer experience program and the Bellevue Development Committee. We are very responsive to developer concerns and needs (Note: e.g., the 60% reduction in the tree credit requirement for certain neighborhoods that will be included with the Omnibus changes at this meeting was the result of heavy criticism from the developer community).
One of the programs highlighted is the free Small Business Consulting Services that can help small business owners confidently navigate the city’s permitting process, from due diligence (before signing a lease) through grand opening celebrations. We’re also planning grant-funded digitization of ~85% of the city’s existing building permit paper records. Evaluation of data from the pilot streamlined review process for single family building permit applications (consolidated review process across departments) will start this summer.
Omnibus LUCA: This is theoretically for annual clean up and alignment with changed state law, but does have some controversial elements this time. There are five ordinances covering different sections of the change. The first four (Ordinances 6930-6933) are Land Use Code Amendments (LUCAs), and the last (Ordinance 6934) is a Bellevue City Code Amendment (BCCA):
6930: Allowing childcare in more places (and removal of requirements for Conditional Use Permit, Registration Certificate, fencing, and consideration for limited hours), EV charging stations, removed constraints on office building size in some areas, rockery height to be measured from existing grade, removal of formula for non-conforming lot building height, expanded animals included in kennel restriction (not just pets); rules about shopping carts, change about organic mulch and impervious/hard surfaces, added requirement that play area be contiguous, “average finished grade” wording, clarification about varying definitions (with state and federal laws) and the meaning of shall/may/used/occupied, singular and present tense, gender, etc. Changes to definitions of Bay Window; Building Height; Child Care Center; Daylight Plane; Single-Family Dwelling; Dwelling Unit; Eave; Enclosed Plaza; Modular Construction (new); Owner Occupancy; Passive House (new); director roles; Technical Committee, Transient Lodging, and Vehicle (trailers/boats/large vehicles) definitions
6931: Removed allowance for boardinghouses/B&Bs; Prohibition on single family homes in LDR-2, LDR-3, MDR-1, MDR-2, and PO areas (such as the former R-10; ADUs do not count as the required second unit, so a duplex may be the minimum); Removed requirement for facade modulation and stepbacks for affordable housing; Clarification on fractional affordable housing requirement; FAR limits that apply to middle housing won’t apply to “attached or detached multifamily dwellings” in LDR-2, LDR-3, MDR-1, or MDR-2 areas (?). Removed 10’ setback to private road, ROW, and access easement for back and side yards. Clarification to the 20% threshold for additions to a home. Extra 48” building height allowed for solar energy panel installation. New sections for mass timber, modular, and passive house (exempted from stepbacks, modulation, and parking requirements), passive houses allowed to project out and upward to accommodate insulation thickness. Increase of alternate max impervious surface from 50 to 55% for middle housing in LL-1 through SR-3, and a 5% increase in SR-4 and 10% increase in LDR-1 areas. Rules for redevelopment for housing, supportive housing, or homeless services. Streetscape material appearance, high/quality and durable material requirement, and building massing rules removed (generally and in the BelRed and East Main. Prohibition on single family homes in some BelRed zoning and elimination of live-work allowance in BR-GC, Increased East Main fee-in-lieu; clarification re: surface parking landscape buffer; created a cap on the number of trees planted per linear foot, landscaping strips at the base of the building don’t count toward the green and sustainability factor and should not have weather protection. Articulation of parking structures. Residences won’t count toward the ground floor active use FAR exemption. Changes to unit lot subdivisions and their platting, and short plats.
6932: Environment and Trees: Landscaping requirement reduced for OLB 2 and new land use categories added. Trigger based on parking changes eliminated (to facilitate EV charging installation?). Probable or imminent standard added for tree failure. Reduction in the required tree credits for developments in SR-1 areas (R-2.5) by 60-62.5%. Partial tree credit on property line (formerly zero). No credit for narrow-crown species planted in a hedgerow. Wetland buffers based on Habitat score instead of Water Quality score. Watercourses vs. waters for streams. Type Np will only include perennial streams during normal rainfall, and both Np and Ns must have “surface water connectivity” (including through pipes and culverts(?)), Director discretion for vegetative buffer requirement. Conservation rules for plats and short subdivisions apply along streams with fish or fish habitat, not just those with salmon.
6933: Process changes: Administrative lot split section added, and note about density limit added to the table for Middle Housing. Section with requirement for Master Development Plan removed for phased projects and Design Review removed for those and Downtown projects, but they will still be reviewed by the Director and there still is a process for bounding the MDP. Removed sections about departures and procedural mergers. Similar changes in the BelRed section and Community Mixed Use Design Districts, Medical Institution Districts, Camp and Conference Center Districts, East Main, and Mixed Use Land Use districts (pages 8, 9, 14, 18, and 20). Eastgate TOD still seems to require the MDP so that housing targets can be met. When MDP is not required, can merge site plan and Shoreline CUP into a binding site plan (similar on page 23, 24, and 27), survey and recording section for the Binding Site Plan removed (see new section added at very end). Removed MDP and Design Review requirements for all developments in Factoria’s F1 area and the CCC districts. Design Review may provide phasing plans, conceptual design for landscaping, departures for pedestrian bridge width, and bridge clearance, where MDP is not required. Simplified reference for light rail requirements, appears to be a change. Conditional Use Review for religious structures. Requirement for CUPs, PUDs, Administrative CUPs (and prelim short plats) to be consistent with Comp Plan is removed. List of areas where Design Review is needed for properties that did not have a public comment opportunity, special case for BelRed. Sections added about departures, binding site plans, and when MDPs are needed (pg 32) and what they include, and mergers with binding site plans. Extensions of MDPs. Differences from RCWs may be based on “special circumstances.” Consolidated review for Process I, II, and III and administrative decisions clarified, not about SEPA and Process IV and V decisions removed. Notices may be sent to community groups too. Home occupation permits, variances, and CALUPs will no longer be published or have mail sent as notices, but MDPs are added to the list for publishing, mail, and signs. Which version of the land use rules will apply (filing date, final decision date, litigation delays, etc). Removed requirement that lot splits not create lots large enough to further subdivide. Renter displacement mitigation and survey and recording rules.

5pm deadline to comment on the Kelsey Apartments (link), which will be located at the curve on 118th Ave SE near I-405. Eight stories, 222 units, 280 above and below-grade parking stalls, Kelsey Creek is about 120’ to the north (Under the old CAO rules, this was mentioned to be within 200’ of the OHWM). Stormwater will go rather directly to Mercer Slough. Approx. 10% of the site fits under the Urban Conservancy designation under the shoreline master program.
